Order BEFORE: Judges ENGEL, KEITH and PECK, Circuit Judges On March 16, 1979, the defendant corporations, pursuant to duly authorized corporate resolutions, entered pleas of guilty to a two-count indictment charging them with conspiring to defraud the Federal Maritime Commission by depriving it of its lawful governmental function of regulating rates charged by common carriers of ocean freight, in violation of 18 U.S.C. § 371 and 31 U.S.C. § 1059, and with knowingly and willfully causing certain monetary instruments to be transported to places within the United States from a place outside the United States without filing requisite reports, in violation of 31 U.S.C. § 1101(a). The court accepted the pleas and adjudged the defendants guilty of the offenses charged in the indictment. After hearing argument and receiving and considering briefs filed by counsel for the parties, the district court imposed upon each defendant a fine of $10,000 on Count I and $250,000 of Count II of the indictment.
